Return & Refund Policy

At Breath o’ Fresh Art, we want you to feel confident in your purchase. This policy outlines your rights and our processes in accordance with South African consumer law, including the Consumer Protection Act (“CPA”) and the Electronic Communications and Transactions Act (“ECT Act”).


1. Your Rights Under South African Law

Defective or Incorrect Items (CPA – 6 Month Warranty)

In terms of the Consumer Protection Act, all goods carry an implied 6-month warranty.

If your item:

  • is defective,

  • not fit for its intended purpose, or

  • not as described,

you are entitled to request a:

  • repair,

  • replacement, or

  • full refund.

This must be done within 6 months of delivery, and no penalties or deductions will apply. Where applicable, Breath o’ Fresh Art will also arrange or reimburse reasonable return shipping costs.


Cooling-Off Period (ECT Act – Direct Marketing)

Where applicable under the Electronic Communications and Transactions Act, you have the right to cancel your order within 7 days of delivery, without providing a reason.

  • You will be responsible for the cost of returning the goods.

  • A reasonable cancellation fee may apply, as permitted by law.


2. Our 14-Day Return Policy (Change of Mind)

In addition to your statutory rights, we offer a 14-day return policy for change-of-mind returns.

You have 14 days from the date of delivery to request a return if:

  • you changed your mind,

  • ordered the wrong item or size, or

  • no longer want the item.

Conditions for Return

To be eligible:

  • the item must be unused and in its original condition,

  • with all tags/labels attached,

  • and in its original packaging,

  • accompanied by proof of purchase.

Costs & Fees

  • You are responsible for return shipping costs.

  • A reasonable cancellation fee may be charged, taking into account:

    • payment processing fees,

    • administrative costs, and

    • any costs already incurred in fulfilling the order.


3. How Returns Work

To initiate a return, please email: breathofreshart@gmail.com

Once your request is approved:

  • Breath o’ Fresh Art will coordinate the return with the relevant artist,

  • and provide you with instructions on how and where to send your item.

Please note:

  • Items sent back without prior approval will not be accepted.

  • Your purchase contract is with Breath o’ Fresh Art, and we remain your primary point of contact throughout the process.


4. Damaged, Defective, or Incorrect Orders

Please inspect your order upon delivery.

If your item is:

  • damaged,

  • defective, or

  • incorrect,

contact us as soon as possible at breathofreshart@gmail.com, including photos where possible. We will assess the issue and resolve it in accordance with your rights under the Consumer Protection Act.


5. Non-Returnable Items

The following items are not eligible for return due to change of mind:

  • custom or commissioned artworks,

  • personalised items,

  • gift cards,

  • sale or discounted items.

Note: This does not affect your rights under the Consumer Protection Act in relation to defective goods.


6. Exchanges

We do not process direct exchanges.

The fastest way to receive a different item is to:

  1. return the original item (subject to approval), and

  2. place a new order separately.


7. Refunds

Once we receive and inspect your returned item, we will notify you of the outcome.

If approved:

  • refunds will be processed to your original payment method within 10 business days.

Please note:

  • your bank or card provider may take additional time to process the refund.

If more than 15 business days have passed since your refund was approved, please contact us at breathofreshart@gmail.com.


8. European Union Customers

If your order is shipped to the European Union, you are entitled to a 14-day cooling-off period under EU consumer law.

You may cancel or return your order within 14 days of delivery, provided that:

  • the item is unused,

  • in its original condition and packaging,

  • and accompanied by proof of purchase.
